General Terms & Conditions
By booking and being a part of Trip Your Day tour/daily excursion You agree to and accept the following terms and conditions. This agreement is between You (the participating passenger(s)) and Trip Your Day (a brand of KM Management d.o.o., Tunjice 22f, 1241 Kamnik, Slovenia, henceforth referred to as Trip Your Day) or any agent that is booking and/or paying Trip Your Day in your or any passenger’s name.
1. BOOKING AND PAYMENT
The passenger can book a travel arrangement in the Trip Your Day office or in any other accredited agency/hotel/tourist information centre or by e-mail/phone/online. By making a booking Trip Your Day and the passenger agree a travel agreement, which includes the information regarding the travel arrangement that the passenger has chosen. When making a booking, the passenger has to provide all the necessary information required by Trip Your Day. The reservation is not guaranteed until passenger receive a confirmation from Trip Your Day.

If You book a tour via e-mail your tour is confirmed only when You receive a written confirmation from Trip Your Day and when you complete the payment via any of the offered payment forms.
If You make a booking online, You have to provide all the necessary information and personal documents that are required by the travel arrangement programs and pay the total value of the travel arrangement. By booking a tour through Trip Your Day website, You grant Trip Your Day permission to contact You directly by email. Once Your online booking is complete in all respects, Trip Your Day will issue You a confirmation voucher and send it to the email address You have provided.
Please contact us if You do not receive a booking confirmation for online booking or booking via e-mail, as it might mean that Your order has not been successfully processed or there are internet communication problems. If You do not receive a written confirmation, please check Your junk email folder to see if the email has landed there, then please also check that the email address You entered was indeed the correct one. If You have not received the written confirmation from Trip Your Day, please email us at firstname.lastname@example.org giving us Your full name, the tour You booked (including as much specifics (time, date, etc.) as possible) and request that Trip Your Day resend You the confirmation voucher.
Upon confirmation from Trip Your Day, Trip Your Day will reserve a space for You on the selected trip. It is Your sole responsibility to check the accuracy of the booking and the dates of travel. Trip Your Day reserve the right to accept or reject any booking for any reason, including but not limited to Your failure to make timely payments to Trip
Your Day, Your cancellation or rescheduling of the trip or event or the lack of space on the desired trip or event.
We accept major credit or debit cards (Visa, Visa Electron, MasterCard and Maestro). Credit card charges require certain information and will be processed only upon submission of a completed Trip Your Day submission form. There is no charge or service fee for processing credit or debit card payments. Full payment by credit or debit card is required to make a reservation.

2. PRICE OF TRAVEL ARRANGEMENT
Price of travel arrangement is stated in every travel program and becomes valid with the day of the publication of each program. Prices for all the arrangements are given in EUR and include value added tax. Trip Your Day reserves itself the right to change the prices according to Obligations Code (the changes take place due to changes in currency exchange rates, changes in transport tariffs, changes in fuel prices…). Should the price change occur, Trip Your Day has the responsibility to inform the passenger at the latest 10 days before the day of departure. If the agreed price of the travel arrangement rises more than 10%, it is the right of the passenger to cancel his booking without any financial obligations. Yet it has to be done at the latest 2 days after receiving the notice of the price change.
The inclusions of each tour are clearly marked in the program. Special services are to be paid by the passenger separately. When making a booking, the passenger can express his wishes regarding special services. If they are possible, he will have to provide an additional payment. During the travel the special services have to be paid to the travel guide or to the local guide / organizer directly on the spot.
3. CONTRACTING PARTIES
The booking conditions detailed herein contain the entire contract between You and Trip Your Day. No representation, term, warranty or condition can be expressed or implied by reference to any other writing, advertisement or conversation.
Your contract is with Trip Your Day who reserves the right to nominate to you in writing any other company or person to have the benefit of some or all of the provisions of this contract, which Trip Your Day may then specify, as if you had agreed to the provisions concerned directly with that company or person.
In case Trip Your Day acts as a booking agent and contracts directly with coaches, boats, hostels, hotels and other service providers (individually and collectively the “Other Providers”), all bookings with the Other Providers are subject to their terms and conditions and limitations of liability and Trip Your Day makes no warranties or representations or
assumes any liability in connection with the activities of the Other Providers. It is important to note that some of the Other Provider may limit or exclude liability in respect of death, personal injury, delay and loss or damage to baggage. Trip Your Day does not accept any responsibility for any loss as a result of such actions or as a result of any act or omission of the Other Providers and You agree that Trip Your Day is not responsible for the acts or omissions of the Other Providers.
4. LOCAL PROVIDERS
You will have the opportunity to purchase from Trip Your Day services from local providers at Your chosen destination. These services are not included in the price of your travel package (unless otherwise stated). You are responsible for any additional costs.
Services from local providers purchased by You are run by local operators and You are subject to their terms and conditions.
Services from local providers purchased through Trip Your Day are non-refundable and non-transferable. It is Your responsibility to meet the tour or event at the designated departure point and time.
It is Your responsibility to keep track of any local providers’ vouchers or tickets issued to You by Trip Your Day. Lost vouchers or tickets cannot be replaced.
5. AMENDMENT AND CANCELLATION OF BOOKING ON BEHALF OF PASSENGER
For every amendment after the booking has been made (upon filling in the booking form), if the amendment is possible at all, Trip Your Day charges the passenger the amount of 10 EUR. The passenger has the right to cancel the booking. The cancellation of booking has to be made in writing. Should this occur Trip Your Day reserves itself the right to claim from the passenger the costs that the agency has suffered due to the cancellation of booking. The amount of costs depends on the date when the written booking cancellation was received. Unless stated differently in the travel arrangement, the following cancellation terms are to be considered as valid:
- Any cancellation received until 48 hours prior to departure is free.
- Any cancellations received later than 48 hours prior to departure will be subject to a cancellation fee of 50% of the trip price.
- Cancellation on the day of the departure will be subject to a cancellation fee equivalent to the cost of the trip.
. No refunds will be made in respect of any unused portion of a ticket or partially completed trip.
6. CANCELLATION OF TRAVEL OR CHANGE OF TRAVEL PROGRAM
Although unlikely, tours may be canceled/changed by Trip Your Day due to lack of the minimum number of participants or other unforeseen circumstances. The lowest number of passengers is determined with every program individually. Should it happen that the number of passengers does not reach the minimum of passengers needed for the realization of the travel arrangement, Trip Your Day does not take any responsibility for the damage compensation to the passengers, who booked the travel, yet every passenger is reimbursed the full amount of the payment he previously made.
Trip Your Day has the right to partially or completely resign from the travel agreement, in case during the duration of the travel or the execution of the program occur unexpected circumstances, which could not have been anticipated, eliminated or avoided, yet for Trip Your Day such circumstances represent a justified cause in which the agency would not have concluded the travel agreement if such circumstances would have existed at the time of its conclusion.
Trip Your Day has the right to change the date or time of departure due to the change in the date or time of departure of the means of transport booked for the travel or in case of force majeure, as well as has the right to change the direction of the travel due to changes of the conditions of travel (new timetable, natural disaster or another unexpected cause, that is out of our control) without any reimbursement for the damage and according to the valid regulation of the passenger traffic. As Trip Your Day can not take the responsibility for the changes to the program due to force majeure, which could occur during the execution of the program, the agency has in this case the possibility to offer the passengers its services in another form that the existing conditions allow.
Trip Your Day has the right to partially or completely resign from the travel agreement during the duration of the travel if the passenger does not follow the behaviour rules, which are valid on certain types of transport or in certain accommodation and if the passenger with such behaviour endangers the wellbeing and health of other passengers and prevents the representative of the agency the realization of the travel program.
Trip Your Day reserves the right to cancel/change tours up to but not more than 12 hours prior to the time of departure. In the event a tour is canceled/changed, You will be notified via email or phone. In the event of a cancellation by Trip Your Day You will receive a full refund for the amount paid.
If Trip Your Day holds the responsibility for nonrealization of the program or single services, the passenger is entitled to the reimbursement in amount of the real value of the nonrealized services or according to applicable regulations of the Consumer Protection Act, except in cases when Trip Your Day has the right to cancel the travel arrangement or change of travel program.
Trip Your Day is not responsible for any delay, deviation, or cancellation due to weather conditions. No trip may be cancelled or changed by You any time on the basis of weather conditions.
Trip Your Day is not responsible for delays due to labour disputes, border problems or other political factors.
Trip Your Day is not responsible for delays due to mechanical failure, or other issues that may arise and are outside of Proteus’ control.
Should You not be able to attend a tour or event, or we are unable to offer a tour or event, due to a circumstance beyond our control or a force majeure event, Trip Your Day has no responsibility for tour cancellations, and You will not be entitled to any refunds.
7. TRAVEL DOCUMENTS, PASSENGER RESPONSIBILITIES
It is Your responsibility to make sure You have a valid passport and all necessary visas, permits or certificates on Your person for Your selected trip. Trip Your Day is not liable for any problems, delays or denied entry in the event You are not in possession of valid travel documents.
EU nationals holding a passport or national ID card are not required to show a passport or national ID card if travelling from one border-free Schengen country. For Australian, British, Canadian or American nationals it is required to hold a passport valid for three months beyond the length of stay and issued within the past 10 years. Croatia, Bulgaria, Cyprus, Ireland, Romania and the UK are not a part of the Schengen area, so a passport or ID card is required if travelling to/from these countries.
In case You are not sure whether you need a visa to enter the Republic of Slovenia, check with the Ministry of Foreign Affairs. Third-country nationals must hold a visa in order to enter the Republic of Slovenia.
You agree to comply with the authority and direction of the Trip Your Day guides or Trip Your Day office support, and the laws and regulations of the countries visited, including customs and foreign exchange restrictions.
There may be times when the Trip Your Day guide must make a decision for the safety and/or the best interests of the group. It is a condition of booking that You comply with the authority and decisions of the Trip Your Day guide and You do agree to comply with such authority and decisions. If You do not comply, or if in the good faith opinion of the Trip Your Day guide You are not compatible with the general enjoyment of the group or the smooth operation of the tour (for reasons including but not limited to intoxication, lewd or inappropriate language or behavior, etc.), Trip Your Day reserves the right to refuse to allow You to continue with the tour or the event. You agree that Trip Your Day has the exclusive right to dispel and remove You from a tour or event anytime, without any claims or complaints by You against Trip Your Day. In such a case Trip Your Day will not be liable for any refund, compensation, or additional costs incurred by You.
It is Your responsibility to meet the transportation provided by Trip Your Day at the correct time and location for departure. In the event You miss a planned departure, any extra travel costs incurred are Your sole responsibility and paid by You. Passengers who miss a departure time due to delay or cancellation of incoming transportation are not entitled to a refund. It is Your responsibility to check in with the Trip Your Day office 15 minutes prior to the specified departure time/start of the event. Due to the nature of the services provided, Trip Your Day will not be liable for any damage or costs You may incur if any service departs,
starts, arrives or ends later than the specified time, even if as a result You miss a connecting service or some other scheduled event.
Trip Your Day is not responsible for Your personal belongings. It is Your sole responsibility to look after Your belongings yourself. You agree that Trip Your Day is not responsible for loss, theft or damage to any of Your personal belongings, regardless of the circumstances.
8. HEALTH REQUIREMENTS
Tour participants should check with the consulates and local health boards for the latest health requirements. No medical expenses will be covered for illnesses that occur prior to arrival or on the tour.
9. SPECIAL NEEDS TRAVELERS
Any disability requiring special attention must be reported at the time of booking. Trip Your Day will make reasonable efforts to accommodate the special needs of disabled participants; however we are not responsible for any denial of services by carriers, hotels, restaurants, motor coaches, mini buses, vans and cars are not equipped with wheelchair ramps. We cannot provide individual assistance to a tour member for walking, dining, getting on/off transportation vehicles, or other personal needs. Travelers who need assistance must be accompanied by a qualified and physically able companion.
10. YOUNG TOUR PARTICIPANTS
Tour participants under 18 must be accompanied by an adult.
The underage passengers need to acquire all the necessary documentation for the border crossing of the underage passengers.
11. LOCAL HOLIDAYS
During national holidays certain facilities (museums, restaurants, sightseeing tours and shopping) may be limited or unavailable. Alternatives will be offered whenever possible.
12. COMPLAINTS PERIOD
Every passenger – holder of the travel agreement, has the right to the reclamation of unsuitable services. According to the regulation of the Consumer Protection Act, the passenger has to inform of all the irregularities and deviations from the agreed and paid travel arrangement to the responsible person for the services (whoever carries them out) or the local representative at the travel destination as soon as possible. All must be officialy written and signed from both sides. Should the passenger fail to do so, after returning home he will not be able to hand in a written complaint, if the deficiencies were not completely settled. The passenger has to hand in a written reclamation at least 30 (thirty) days after the conclusion of the travel. In case the passenger misses the legally determined date for the handing in the reclamation, Trip Your Day will not consider his complaint.
The prices of the travel arrangements, unless differently stated in the program, include basic accident insurance, yet they do not include health insurance, which means that the passengers are responsible for taking care of their own insurance. When travelling abroad it is recommended to get the health insurance with global coverage.
Trip Your Day respects the privacy of the visitors of its website and ensures that personal information you submit to us will be treated confidentially. Processing of personal data is carried out in agreement with the requirements set by the Personal Data Privacy Law of the Republic of Slovenia.
15. FINAL PREMISES
Participation in any of our tours, events and/or services is strictly voluntary. As in all human endeavors, there is a level of risk. We do our best to keep the risk at a minimum. Trip Your Day, its contractors, parent and subsidiary companies, and employees assume no liability or responsibility for any injury, loss, damage, inconvenience, sustained by any person using its services. We will not be held in any way responsible for injuries to body, person, or property incurred during the tour. We reserve the right to deny participation to anyone for any reason at any time. Thank You for understanding.
By making a booking every passenger gives Trip Your Day his permission to use the photographs and videos made on the travel (the photographs and videos could include every passenger) in promotional and commercial intentions. These photographs and films may be used for publicity and advertising without Trip Your Day obtaining further consent from You or making any payment to You in connection with the permitted uses. Trip Your Day does not take any responsibility for the behaviour of passengers and damage that passengers would cause during the travel.
In the event of dispute between Trip Your Day and the passenger the legal procedure is in competence of the court in Ljubljana.
